Temporary Ban Warning for US TikTok Users Starting Sunday

As of Saturday afternoon, TikTok has started notifying U.S. users about its impending unavailability in the region. This decision comes as a direct consequence of the U.S. Government’s mandated sell-off bill, which will take effect shortly.

Currently, TikTok is actively working towards a solution to this challenging situation. However, given the legal framework, there appears to be no feasible way to circumvent the law, which is set to be enforced starting at midnight tonight.

The final opportunity for TikTok to seek legal intervention was through the Supreme Court, which recently upheld the provisions of the “Protecting Americans from Foreign Adversary Controlled Applications Act.” This ruling requires TikTok to either undergo a sale to a U.S.-based company or face a shutdown in the United States. With the limited timeframe, the latter option has unfortunately become the only viable path for the app owned by a Chinese company.

As we have reported previously, this shutdown will also affect CapCut, TikTok’s video editing companion app, highlighting the broader implications of this legal decision.

The silver lining in this situation is that both TikTok and CapCut (as well as Lemon8) are expected to re-emerge for American users very soon. Incoming President Donald Trump has indicated he is “most likely” to extend a 90-day grace period for the company, allowing for negotiations towards an alternative solution and providing Trump himself a chance to orchestrate a new agreement.

Initial reports suggested that there might not be any disruption to the app, as the Biden Administration appeared hesitant to enforce the sell-off bill, potentially leaving its resolution to the incoming Trump administration. However, according to the wording of the law, it is the app stores that bear the responsibility for enforcing the removal of TikTok. With the Biden team unable to provide assurances against potential fines, the only choice left was to terminate access.

This scenario sets the stage for Trump to potentially save TikTok.

Interestingly, Trump has developed a fondness for TikTok, becoming a prominent figure on the platform. Thus, he is motivated to find a way to preserve its presence in the U.S. Nevertheless, since he does not officially take office until Monday, he is unable to intervene to halt the law’s enforcement scheduled for the day before.

This is likely why TikTok is currently characterizing the situation as temporary, as it seems Trump has committed to reinstating the app as swiftly as possible.

It is also noteworthy that TikTok’s CEO, Shou Zi Chew, will be present at Trump’s inauguration on Monday, indicating a willingness to engage with the new administration.

To clarify, it is important to note that Trump did not initiate the TikTok ban back in 2020.

In actuality, Trump’s efforts to ban TikTok in 2020 stemmed not from national security issues but rather as a response to tensions with China following the COVID-19 pandemic. He issued an executive order aimed at prohibiting the app, yet the justification for this action was deemed insufficient, as the Trump Administration lacked the necessary evidence to support the ban.

This led to the Biden Administration reconsidering the original push for a TikTok sell-off in 2021. However, security agencies continued to monitor TikTok for potential threats, uncovering indications that Chinese entities might be utilizing the app to disseminate pro-China narratives or extract user data.

The exact findings of these investigations remain undisclosed, as the authorities have opted to keep comprehensive details confidential. Nevertheless, it was this renewed scrutiny that ultimately resulted in the approval of the current TikTok sell-off bill.

While Trump’s attempts to ban TikTok in 2020 may seem contradictory to his potential role as the app’s champion, it is essential to recognize that these actions were based on different contexts and justifications.

The future now appears to favor Trump’s involvement, potentially allowing him to negotiate a new sale of the app to a U.S. company or consortium, or to broker a fresh agreement with China to maintain its normal operations.

It seems likely that Trump will need to devise a new arrangement to satisfy the legal requirements, which could result in TikTok falling under the control of one of his supporters. Regardless, considering Trump’s enthusiasm for the platform, it now appears that TikTok will only experience a brief hiatus before returning to the U.S. market.

Therefore, there is no need to overhaul your strategies or reconsider your influencer marketing initiatives. TikTok will be back soon, although it may be temporarily unavailable for U.S. users starting tomorrow.
