Creators of Banned ICE Trackers Win Ruling on First Amendment Rights

A federal judge has issued a preliminary injunction that favors the creators of the “ICE Sightings – Chicagoland” Facebook group and the Eyes Up app, effectively halting the Trump administration from pressuring platforms to eliminate these vital projects. Judge Jorge L. Alonso of the United States District Court for the Northern District of Illinois determined that the plaintiffs, Kassandra Rosado and the Kreisau Group, have a strong likelihood of succeeding in their legal challenge. This lawsuit claims that the government engaged in actions that suppressed protected speech under the First Amendment by coercing Facebook and Apple to remove essential ICE monitoring initiatives.

The Eyes Up app and ICE Sightings – Chicagoland rely on publicly accessible information to monitor ICE activity effectively. However, following intense pressure from officials within the Trump administration, these applications were subsequently removed from Apple’s App Store and Facebook. In addition, similar applications such as ICEBlock and Red Dot were also taken down from both the App Store and Google Play. The lawsuit references social media posts made by former US Attorney General Pam Bondi and former Secretary of Homeland Security Kristi Noem, which not only called for the removal of these apps but also boasted about their success. Judge Alonso described these posts in official court documents as “thinly veiled threats,” indicating the serious implications of governmental interference.

The Foundation for Individual Rights and Expression (FIRE), which is providing legal support for the plaintiffs, expressed its optimism regarding this ruling in a post on X. They stated that they are “extremely encouraged by this ruling,” adding that while it does not conclude the case, it significantly strengthens their ongoing legal battle. This ruling is seen as a positive sign for the future of defending First Amendment rights, particularly the right to openly discuss, document, and critique the actions of law enforcement in public settings.
