The troubling incident reportedly took place in January 2024 when law enforcement was summoned to the residence of Sergio Nino concerning his then-16-year-old son, also named Sergio. Mr. Nino alleged that his son had been exhibiting troubling behavior at home, including substance abuse and chronic truancy, which escalated into a physical confrontation when the father attempted to remove his son’s bedroom door.

During the alleged conflict, Mr. Nino reported that he inadvertently fell on top of his son, which escalated into a struggle over the teenager’s mobile phone. Following this, the father called the police, claiming that his son had spat at him and attempted to hit him during the altercation, stating that his daughter, who witnessed the event, was siding with her brother.

Mr. Nino further disclosed that his son has a history of mental health issues and has previously been admitted to treatment facilities. He noted that he has had to call the police regarding his son on multiple occasions in the past due to his erratic behavior.

After relaying his perspective to the responding officers, bodycam footage released to FOX 10 Phoenix shows Mr. Nino revealing that a police officer from a prior incident had advised him to “physically discipline” his son, reflecting a concerning attitude towards the treatment of minors.

When Mr. Nino expressed that he could not resort to physical punishment because he feared incarceration, an officer on the scene assured him, “No, you don’t,” suggesting a troubling endorsement of violence.

Mr. Nino conveyed his despair, stating, “I don’t have control of my own home,” and shared that he has been trying to find a way to either place his son on some form of legal hold or in juvenile detention. The officers present proposed various solutions, including emancipation, placing the youth in a group home, or punishing him by ceasing financial support for the teenager’s mobile phone and vehicle.

“We don’t parent people. That’s your responsibility,” one officer told Mr. Nino. “If you want to physically discipline him, you physically discipline him,” further stating, “If you want to hit him, you can hit him.” This shocking dialogue raises critical questions about policing practices and the treatment of minors in distress.

“They might call child services, but if they see you’re disciplining him, they’ll throw it in the shredder,” the officer continued. “If he’s going to treat you like garbage, you have to treat him like garbage. Throw him out on the street,” advocating for an alarming approach to conflict resolution.

After the father expresses his reluctance to take extreme measures, the officer suggests removing the teenager’s bedroom door entirely, asserting, “He shouldn’t be running this house,” as Mr. Nino requests that the officers engage in conversation with his son.

The adolescent, Sergio, states that his father “tackled” him during the confrontation, prompting an officer to respond, “He can do this. He’s not abusing you. He’s trying to discipline you because you’re acting like a little brat.” This statement raises concerns about the normalization of violence within family dynamics.

“Your dad should beat you. Other than sending you to the hospital, your dad should beat you. As a kid, you have to take it,” the officer continued, further dismissing the teenager’s claims of mistreatment. “You have no rights. Are you paying for your car? House? Phone?”

The son, expressing his frustration, pushes back against the officer’s comments, questioning whether they have fully grasped the scenario before asking them not to touch him. The officers respond by threatening to handcuff him for “being a little brat” and for his father’s allegations of assault.

The situation escalates as the teenager’s sister attempts to defend her brother. The officer instructs her to return to her room, leading to a heated argument. During the chaos, the officer tries to seize the son’s phone, which Sergio asserts is his personal property, as he attempts to document the interaction.

A physical struggle ensues, culminating in the younger Sergio being pinned to the ground, blood pooling beneath him while he cries out in pain and insists that his restraints are “too tight.” This alarming scene raises questions about the use of force by law enforcement in family disputes.

As he is taken outside, Sergio continues to express distress, claiming he is being charged with aggravated assault after he purportedly “lunged” at the officer, while he maintains that he was merely trying to retrieve his phone.

“Stop crying. I don’t need a warrant,” one officer instructs him, while another officer asserts, “It’s not yours; it’s your dad’s. That’s how it works!” This exchange highlights the tension and misunderstanding between the officers and the teenager.

As the officers escort him outside, Sergio states, “I’m going to get some money too.” One officer retorts, “Yeah, big zero,” as they begin wiping the blood off their uniforms, illustrating a troubling lack of empathy and professionalism.

Regarding the teenager’s father, one officer remarked, “He’s scared to lose his job to hit you, which he should have been doing for a long time.” The teenager, however, counters that they “really don’t understand” the situation, revealing a troubling history of abuse at the hands of his late mother and witnessing his father’s abusive behavior towards her.

Although the teenager, now 18 years old, has yet to file a lawsuit against the City of Phoenix or the three involved officers, his legal team has submitted a notice of claim seeking a $500,000 settlement. “If the city does not resolve the claim, a federal lawsuit will be filed against the City of Phoenix and the involved officers,” his attorney informed 12 News in a statement, indicating a possible escalation in legal action.

According to the notice of claim, the younger Sergio allegedly sustained a 3-centimeter laceration to his face during the altercation, in addition to suffering a fractured wrist that required surgical intervention. This injury raises serious concerns about the appropriateness of the force used by law enforcement during the incident.

The claim further alleges that the teenager “may be left with permanent facial scarring,” and notes that, “Sergio’s wrist injury has significantly hindered his ability to engage in daily activities, such as writing, exercising, and playing video games.” This highlights the long-term ramifications of police interactions with minors.

“To this day, Sergio’s daily life has been restricted by his wrist injury. He continues to suffer from the physical and emotional ramifications of his injuries, alongside accumulating medical expenses,” his attorneys argue, emphasizing that “there was no imminent threat” to officers at the time they applied excessive force against Sergio. They also assert that there was no lunge towards the police, contradicting the officers’ narrative that justified their aggressive takedown and handcuffing.

“The officers’ use of excessive force, along with their deliberate indifference to his injuries caused by that force, was objectively unreasonable,” they added, raising significant concerns regarding law enforcement practices and accountability.

A police department spokesperson informed ABC 15 that the incident is currently under litigation, while sources suggest that it is also undergoing review, highlighting the ongoing scrutiny into law enforcement practices in such sensitive situations.
