Diddy Won’t Testify in Federal Trial, Praises Judge Instead

At 55 years old, Combs has maintained his not guilty plea throughout the proceedings. He is currently being held without bail in a federal detention center located in Brooklyn, having faced multiple rejections of his bail appeals by various judges over the course of the last year.

On this day, the prosecution concluded its case after an exhaustive six-week presentation of evidence aimed at building its argument against the hip-hop icon. Judge Arun Subramanian indicated that he would issue a ruling on the motions at a later date. Notably, Diddy previously secured an acquittal in 2001 related to a nightclub incident, while Shyne, a key figure in that situation, served nine years in prison.

As the afternoon progressed, the defense rested its case without calling any witnesses, contrasting sharply with the prosecution’s approach, which included the testimonies of 34 witnesses attempting to establish the validity of the charges of sex trafficking and racketeering conspiracy that led to Combs’ arrest in September.

The defense contended that the prosecution had failed to prove its case, arguing that Diddy’s two former girlfriends did not feel coerced into participating in what were described as marathon sexual events with male sex workers. Instead, the defense characterized these “freak-offs” or “hotel nights” as consensual interactions that aligned with a swingers lifestyle.

Combs emphasized that the decision not to testify was made after thorough discussions with his legal team. “That is my decision, your honor,” he stated clearly, further asserting: “That is solely my decision.” When pressed by the judge, he elaborated: “I mean, it’s my decision with my lawyers. … My decision to make. I’m making it.”

Since the trial commenced in early May, the prosecution has called upon former employees of Combs’ companies to provide testimony. However, a significant portion of the evidence has come from the accounts of two former romantic partners: Casandra “Cassie” Ventura and a social media figure known by the pseudonym “Jane.”

During the initial week of the trial, Ventura took the stand for four days, revealing that she felt compelled to engage in numerous “freak offs” as a means to maintain intimacy with Combs after participating in sexual acts with male sex workers, which he allegedly observed. She recounted instances where they would apply baby oil to each other and on occasion, Combs would record these encounters.

On the other hand, Jane testified for six days, describing the sexual performances she referred to as “hotel nights.” She expressed that her understanding of these events changed after starting therapy three months prior, stating she felt coerced into participating in these acts as recently as August but did so out of love for Combs. Ventura’s relationship with Combs spanned from 2007 to 2018, while Jane was involved with him from 2021 until his arrest, which abruptly interrupted her plans to meet him at a New York hotel.

Throughout the trial, the defense has actively challenged the testimonies of these witnesses, striving to build a case for Diddy’s exoneration. Several witnesses only agreed to testify after securing immunity from potential legal repercussions stemming from their involvement.

Active Participation in His Defense Without Testifying

Despite not taking the stand, Combs has been an engaged participant in his defense strategy. He has taken meticulous notes, assisting his lawyers in determining the appropriate moments to cease questioning witnesses. During the trial, the judge had to address Combs when he was observed nodding enthusiastically toward jurors during a favorable cross-examination by his attorney. Prosecutors objected, suggesting that such gestures amounted to testifying without the opportunity for cross-examination, prompting the judge to caution that he might exclude Combs from the proceedings if this behavior continued.
