Unraveling the Complications of Irena Green’s HOA Dispute
Irena’s ordeal began with a formal notice from The Trowbridge Company Inc., the management entity of her HOA, highlighting the issue of her lawn’s browning grass. “The grass has started turning brown. So then they started sending notes,” Irena recounted to ABC Action News. She attributed this problem to a large tree that casts shade over her yard and the drought-related watering restrictions imposed in her community. “If you drive around my neighborhood, you’ll see there’s plenty of yards not up to par,” she emphasized, highlighting the inconsistency in enforcement. Unfortunately, the HOA remained unyielding despite her explanations.
The HOA continued to issue more violation notices for additional issues, including a dirty mailbox, a dented garage door, and a commercial cargo van parked in her driveway. Irena argued that similar vans were prevalent in her neighborhood, which made her feel unfairly targeted. After ignoring a mediation request, the HOA escalated the situation by hiring attorney Francis Friscia to initiate a lawsuit against her in Hillsborough County Civil Court.
Irena decided to respond to the lawsuit without legal representation, believing she could handle the matter on her own. However, her response was rejected by the judge due to procedural issues. In July 2024, the court issued a 30-day ultimatum, demanding she rectify the violations or face incarceration. “He said you can get seed, you can do something, but you’ve got 30 days to get it corrected,” she recalled. In an effort to comply, Irena took immediate action by selling her van, cleaning her mailbox, and reseeding her lawn. However, her troubles were far from over.
How a Missed Court Hearing Led to Irena’s Arrest
Irena believed she had made sufficient efforts to resolve the issues, but the HOA remained dissatisfied. The real crisis arose when she missed a critical follow-up court hearing in August 2024.
“I was supposed to receive documentation. Nothing was sent to my home. And I reached out to the courthouse several times to try to find out when was my court date,” she explained, expressing her frustration.
The judge, unimpressed by her absence, found her in contempt of court and issued a warrant for her arrest, allegedly at the request of attorney Friscia. On May 23, while driving her 15-year-old daughter home from cheerleading practice, Irena was pulled over by a deputy. “He asked me can I get out. When I got out he said, ‘Ms. Green, did you know that you have a warrant for your arrest?’” she recounted, recounting the shock of the moment.
She was handcuffed and taken to jail without the option for bond. “There was no bond. So I couldn’t even go home to my family. I sat in there for seven days. Seven days in the jailhouse like a criminal,” Irena described her experience, highlighting the emotional and psychological toll it took on her. She faced two charges: contempt of court and failure to comply with a court order to show cause.
Irena’s Release and Ongoing Legal Battles
After spending six days in jail, Irena’s sister-in-law stepped in and filed an emergency petition on her behalf. During the hearing, her sister-in-law presented photographic evidence showing that the lawn issues had been addressed. A different judge ruled for her immediate release, despite the HOA attorney’s attempts to prolong her detention.
“It makes me feel horrible. I work hard to buy this home for me and my kids in a better neighborhood and environment, and to be taken to jail and to be treated like that for brown grass at my own home … that’s horrible,” Irena expressed, reflecting on the injustice she felt.
Currently, Irena faces significant legal fees and a looming threat of foreclosure from the HOA due to unpaid dues. “I think they have way too much power. I’ve never heard of anything like this in my life,” she lamented, underscoring her concerns about the authority of homeowners associations and their impact on residents.
