TikTok’s Efforts to Overturn US Sell-Off Bill Fail

A recent decision by a U.S. appeals court has dealt a significant blow to TikTok’s efforts to challenge the government’s mandated sell-off legislation. This ruling positions TikTok on the brink of potential removal from the United States, with a deadline looming on January 19, 2025, for compliance. The implications of this ruling could reshape the landscape of social media in the U.S., affecting millions of users and raising concerns about where they might turn for similar platforms.

While TikTok still has some pathways to explore in order to avoid this sell-off order, it may have allies in President-elect Donald Trump, who has expressed intentions to support the app’s continued presence in the U.S. This political backing could prove pivotal, but the outcome remains uncertain as the situation evolves.

However, the future remains contingent on several unpredictable factors that could influence TikTok’s fate in the U.S. marketplace.

The decisive ruling from the U.S. Court of Appeals for the District of Columbia Circuit concluded that TikTok’s assertion that the mandated sell-off infringes upon the First Amendment rights is not applicable in this context. The court cited significant concerns regarding foreign adversaries, particularly the potential for manipulation of American citizens through the app, as a reason to uphold the bill.

According to the court’s statement:

“The People’s Republic of China is identified as ‘a foreign adversary’ that ‘continues to threaten the national security, foreign policy, and economy of the United States’ through its control of ‘software applications’ used in the United States.”

The court substantiated its decision by referencing China’s ongoing attempts to meddle in U.S. democracy through various digital channels. These findings, supported by extensive investigations, provided a legal basis for dismissing TikTok’s claims regarding First Amendment protections.

Consequently, TikTok’s challenge to the sell-off mandate has been effectively nullified. This outcome places the company in a precarious position, where it must either finalize a sale to a U.S.-based entity or exit the market entirely by January 19.

What strategic options does TikTok have moving forward?

One avenue could involve seeking a partnership with a U.S. company to satisfy the government’s sell-off requirements. During the previous attempt in 2020, under Trump’s administration, an Oracle and Walmart consortium emerged as a potential partner. This deal was on the verge of completion but was ultimately halted when President Biden rescinded Trump’s sell-off directive.

With Trump’s potential return to power, there may be an opportunity to revive this partnership; however, Chinese officials have expressed strong opposition to any sale, viewing the bill as an encroachment by the U.S. government.

Regardless, keeping TikTok operational in the U.S. might be preferable to an outright ban, potentially paving the way for negotiations. Alternatively, TikTok might consider appealing to the U.S. Supreme Court, which it appears to be preparing to do, or rely on President Trump’s commitment to overturn the sell-off legislation using his executive powers.

In theory, Trump could issue an executive order that effectively nullifies the sell-off requirement. However, whether he will take such a step and risk tensions with the Senate is yet to be determined.

Another possible route for TikTok is to request an extension, which would grant the company an additional 90 days to devise a strategy that addresses the government’s concerns. This extension could allow TikTok to remain operational in the U.S. until at least April of the following year, potentially aligning with Trump’s inauguration, increasing the chances for assistance.

While Trump has not elaborated on how he would support TikTok, he has stated his intention to preserve the app, even noting that he is now considered “a big star” on the platform. This could serve as motivation for Trump to leverage his influence to counter the sell-off mandate; however, some speculate that his association with Elon Musk, who operates a competing social media platform, might reduce his inclination to advocate for TikTok’s interests.

(Note: Musk himself has stated that he supports TikTok remaining available in the U.S.)

At present, the outlook for TikTok’s presence in the U.S. appears quite bleak.

TikTok has responded to the court’s ruling with a statement:

The Supreme Court has an established historical record of protecting Americans’ right to free speech, and we expect they will do just that on this important constitutional issue. Unfortunately, the TikTok ban was conceived and pushed through based upon inaccurate, flawed and hypothetical information, resulting in outright censorship of the American people. The TikTok ban, unless stopped, will silence the voices of over 170 million Americans here in the US and around the world on January 19th, 2025.”

As the situation stands, the resolution now depends on the U.S. Supreme Court and potentially President Trump’s intervention to determine TikTok’s fate. Absent favorable outcomes, the app may be forced to exit the U.S. market early next year.
