
Nintendo is taking decisive legal action against Genki, the accessory manufacturer that displayed unauthorized mockups of the unreleased Switch 2 at CES 2025. In a lawsuit filed on Friday, Nintendo accuses Genki of trademark infringement, engaging in unfair competition, and committing false advertising. Nintendo argues that Genki initiated a strategic campaign to exploit the widespread public interest surrounding the upcoming next-generation console. According to the lawsuit, Genki promoted accessories it claimed were compatible with the Switch 2 without any official authorization and misused the iconic Switch logo to bolster its claims.
Following the initial reports in January regarding Genki’s showcasing of Switch 2 mockups at CES and a video that purported to present a 3D render of the console, Nintendo issued a statement clarifying that neither the hardware nor the imagery associated with it were official representations. Despite Genki’s initial assertions of possessing a Switch 2, the company later clarified that it does “not own or possess a black market console.” Furthermore, Genki informed media outlets that its mockups were solely based on leaked information. In the lawsuit, Nintendo contends that Genki’s public statements have been “contradictory and inconsistent,” yet the company continued to assert to consumers that its accessories would be compatible with the Nintendo Switch 2 upon its official release.
Nintendo officially announced the Switch 2 on January 16, just over a week after Genki’s mockups were presented at CES. In the months that followed, Nintendo alleges that Genki “continues to exploit media attention and fan interest” while undermining the sales of Nintendo’s own accessories. This includes Genki’s actions of launching its own “Genki Direct” event immediately following Nintendo Direct presentations. In a statement shared on X after the lawsuit was filed, Genki expressed that it is “taking the matter seriously and is collaborating with legal counsel to formulate a thoughtful response.”
“What we can share is this: Genki has always prided itself on being an independent company dedicated to creating innovative gaming accessories for the community we cherish,” Genki’s statement continued. “We take great pride in our work and firmly stand behind the quality and originality of our products. While we are unable to provide detailed comments at this time, we are diligently preparing to fulfill existing orders and showcase our latest products at PAX East later this week.”
The much-anticipated Nintendo Switch 2 is set to launch after years of speculation and rumors surrounding its development. In the lawsuit, Nintendo mentions that planning for the next-gen console commenced shortly after the original Switch was released. Pre-orders for the Nintendo Switch 2 became available in April, and the console has already generated substantial excitement among fans and gamers alike.
