The Los Angeles County District Attorney, Nathan Hochman, is currently seeking to delay proceedings in the controversial case of the Menendez brothers. He has filed a motion at the last minute aiming to postpone Thursday’s highly anticipated resentencing hearing, indicating a need for further evaluation of the situation.
On Wednesday evening, Hochman submitted his motion to the L.A. County Superior Court, requesting that today’s crucial hearing not proceed as planned. He argues that the court requires additional time to thoroughly review the California parole board’s risk assessment report concerning Erik Menendez and Lyle Menendez, which is essential for an informed decision.
In a significant directive, Governor Gavin Newsom instructed the parole board in February to carry out an in-depth risk assessment of the brothers prior to any decisions regarding clemency. This step is crucial in determining the future legal standing of Erik and Lyle Menendez.
According to the filing obtained by TMZ, Hochman asserts that the parole board has completed its evaluation of Erik and Lyle Menendez. Moreover, the governor has invited the court to formally request the completed report to facilitate the upcoming resentencing hearing.

Hochman contends that the court should diligently seek to obtain the parole board’s assessment report. He argues that if additional time is necessary for this process, the judge ought to consider postponing the resentencing hearing, effectively allowing for a more informed decision regarding the future of the Menendez brothers.

Governor Newsom intends to utilize the findings from the risk assessment report during a hearing set for June 13. During this session, both Erik and Lyle will have the opportunity to appear before the board for their individual evaluations.
