“In an urgent injunction, the Berlin Regional Court last Thursday instructed X to provide real-time access to data related to the upcoming German elections via its online interface until February 25. The plaintiffs, Democracy Reporting International (DRI) and the Society for Civil Rights (GFF), argue that X has obstructed their efforts to monitor potential election interference by withholding crucial engagement metrics like likes, shares, and visibility data.”

X is legally obligated to furnish this information upon request, yet it has remained noncompliant.

According to Article 40 of the EU Digital Services Act (DSA), designated online platforms like X must grant approved researchers access to essential data to facilitate the analysis of systemic risks associated with their operations. This regulatory framework aims to promote transparency and accountability in the digital landscape.

Despite the legal requirements, X has chosen to defy the court order, leading to speculation that the platform seeks to avoid compliance until after the German elections on February 23. This situation raises significant questions about X’s impartiality and adherence to EU regulations, especially given Musk’s public support for the right-wing AfD party.
