Can User Data Be Trusted with Meta’s AI Agents?

With the unveiling of Meta’s innovative AI agents, the company has embarked on a strategic public relations campaign to assure users of its commitment to data security, despite a history marked by data controversies.

Meta’s Muse AI agents aim to simplify tasks for users by performing a variety of functions, such as browsing the internet, making purchases, analyzing financial data, suggesting insurance plans, and exploring health-related information.

Essentially, Meta’s Muse AI agents can deliver insights based on the data users choose to share. for these insights to be genuinely beneficial, users must grant access to a broader spectrum of their personal data and sensitive information.

Meta seeks to foster a sense of security among users, which is why it has outlined comprehensive data-protection measures that correspond with the use of Muse, ensuring that any information shared with the AI agent is securely stored and shielded from external access, including from Meta itself.

However, gaining public trust remains a significant hurdle for widespread adoption of this technology. Numerous lawsuits have illustrated that Meta’s philosophy of “move fast and break things” tends to prioritize rapid innovation over user safety, resulting in repeated data breaches and negative outcomes that are often recognized only in hindsight.

To highlight the importance of vigilance, here is a partial list of instances where Meta has faced accusations of mishandling user data over the years:

• In 2007, Meta was sued by a user for publicly exposing private information through its Beacon program, as reported by The Washington Post. Meta resolved the lawsuit by discontinuing the Beacon program and establishing a $9.5 million fund for privacy and security (New York Times).
• Also in 2007, Meta had to terminate a program that utilized Facebook users’ names and images in advertisements without obtaining consent. The company settled by compensating affected users (Bloomberg
• In 2011, Meta faced litigation for tracking user actions off Facebook using cookies. After a lengthy battle, Meta finally agreed to pay $90 million to settle the case in 2022 (The Verge).
• In 2014, Meta was accused of scanning users’ private messages to gather data for targeted advertising. To settle this case, Meta agreed to stop using data from direct messages (Courthouse News Service).
• In 2014 and 2015, regulators in France and Belgium took legal action against Meta for tracking non-users and logged-out individuals for advertising purposes (The Guardian).
• In 2016, Meta faced legal challenges regarding its use of facial recognition technology in its photo-tagging feature. This, along with several similar lawsuits, led to the company shutting down its facial recognition program in 2021.
• In 2018, Meta was sued due to a data breach that compromised the personal information of approximately 30 million users (The Denver Post).
• In 2019, Turkish authorities imposed a fine of $282,000 on Meta for breaching data protection laws that affected nearly 300,000 individuals (Reuters).
• In 2019, the FTC imposed a $5 billion fine on Meta, mandating new regulations and requirements following the Cambridge Analytica scandal.
• In 2021, Meta was sued for violating public trust by knowingly developing systems that caused harm to maximize profit. This stemmed from an internal data leak by former employee Frances Haugen, leading to multiple related lawsuits (The Guardian).
• In 2022, Meta faced a lawsuit exceeding $3 billion, alleging that data from 44 million UK Facebook users had been exploited upon joining the platform (The Guardian).
• Also in 2022, the Texas Attorney General’s office filed a lawsuit against Meta for collecting user biometric data without consent. Meta ultimately agreed to pay $1.4 billion in damages and discontinue its biometric data collection practices (The Washington Post).  
• In 2022, Meta was also sued over the collection of individuals’ health data (TechTarget).
• Additionally, in 2022, Meta was fined $461 million by Irish regulators for infringing on children’s privacy rights (BBC).
• In 2023, Meta was penalized with a historic fine of $1.3 billion by the European Data Protection Board for transferring EU user data back to the U.S. without securing explicit consent or necessary safeguards (CNBC)
• In 2024, the Irish Data Protection Commission levied a $263 million fine against Meta for a data breach that compromised the personal information of 29 million Facebook users. 
• In 2026, hackers successfully accessed over 20,000 Instagram accounts by deceiving Meta’s AI-powered support bot.
• Also in 2026, Meta consented to pay $18 billion in penalties, along with implementing new protocols, to resolve a lawsuit filed by a coalition of U.S. attorneys general that accused the company of downplaying the extent of mental health issues linked to its apps among children.

It’s important to note that this list does not encompass all instances of Meta’s alleged data misuse and the subsequent lawsuits, which have collectively cost the company over $25 billion in fines and led to the implementation of numerous regulations aimed at safeguarding user information. 

There is hope that Meta has learned from these experiences and will integrate those lessons into its new Private Processing framework for Meta AI which will handle user data collected by its devices within “secure virtual environments.” 

Nonetheless, the company has a well-documented history of advancing with its products, only to confront the consequences later.
